Foreshadowing in John Steinbecks Of Mice and Men - Research Paper Example Steinbeck himself cared deeply about the lives of migrant workers as evidenced by his compassionate tone and creation of complex characters struggling in a competitive society. Steinbeck combined styles of modernism and realism to explore the lives of people living in and traveling through Southern California. Steinbeck’s parents, a Monterey treasurer and a school teacher/stay-at-home mom, taught him a love of literature from an early age. Although he did attend Stanford University for three years, he left without completing his degree. These years, as well as his journalism job, provided the formative substance of his writing career for he worked and traveled throughout California as a short-term hired hand at mills, farms, and larger estates. During these years he came face to face with the resilience with which migrant workers faced their destitute, unstable lives. Throughout the rest of Steinbeck’s career he focused Name 2 on the plight of the underdog within an inc reasingly unfair, capitalistic world. He was awarded the Pulitzer Prize for his monumental novel, The Grapes of Wrath, focused on the dreams and tragedy of the Joad family, and for his combined works he was awarded the 1963 Nobel Prize. All of Steinbeck’s characters face issues equally derived from competitive social forces, the economic downfall known as the Great Depression, and the seasonal nature of the farming economy. The 1930s saw vast technological advances in farm machinery that drastically reduced the number of men needed to operate a farm. In 1900, about 125, 000 workers traveled from Minnesota to Washington searching for work, but by the 1930s the numbers of out-of-work men looking for positions had doubled. Farms were becoming corporate industries with the absent owners living in cities hiring managers to run the farms. Migrant workers, nicknamed â€Å"bindle-stiffs† as they packed up and followed the seasonal harvests, were severely underpaid, had no unio n or legal representation, or stable homes. In the later 1930s, violent strikes broke out in several areas leading to some improvements, yet most farm owners continued to treat their migrant workers as disposable. This lifestyle continued until World War II dramatically altered the lives of all Americans as itinerant workers had the option to enlist and the defense industry expanded to insure food rations for citizens and soldiers. Steinbeck’s social experience of living with migrant workers and journalistic knowledge of the economics of itinerant life greatly influenced his novella Of Mice and Men. The very title indicates the central question considering the value of life as it links the smallest burrowing creature’s life to the hopeful pride found in the positive view of Name 3 American manhood. The novella begins with George and Lennie on the run. They are escaping their recent post at a farm called Weeds where Lennie scared a young woman by inappropriately but inn ocently feeling her dress causing her scream as if she were being physically assaulted. This situation introduces readers to the roving nature of their farm work, Lennie’s inability to control his actions, and the tight protective relationship between these two men. These two protagonists create a symbiotic relationship as they feed each other’s dreams of a owning a farm while making their migrant life bearable. â€Å"

And Sun Also Rises Essay This paper discusses Ernest Hemingway’s novel And Sun Also Rises (1926) and takes an in-depth analysis of the development of the female character Lady Brett Ashley in trying to come up with better understanding of the character’s role in the novel. Hemingway’s And Sun Also Rises is widely regarded as Hemingway’s best novel. It became the overnight Bible of the postwar generation. (Barrett, 724) The novel revolves the theme of damage done to Hemingway’s generation by the violence of World War I. All the main characters of the novel are to certain extent scarred by war. Some of them suffer physical injuries like Jake or Count Mippipopolous and others bear the psychological trauma of â€Å"lost generation† (the phrase belonged to Hemingway’s friend Gertrude Stein and became the novel’s first epigraph). Among those psychologically deteriorated individuals Lady Brett Ashley is a controversial character that evokes different readers’ and critics’ reaction. This paper explores the path by which Lady Ashley’s character develops through the novel. With the first meeting with Brett Ashley her individual female sexual appeal and exceptional general attractiveness is revealed. From the beginning of the book, men find her irresistible. When Jake, as narrator, first introduces Brett, he says, â€Å"Brett was damned good-looking. She wore a slipover jersey sweater and a tweed skirt, and her hair was brushed back like a boy’s. She started all that. She was built with curves like the hull of a racing yacht, and you missed none of it with that wool jersey† (Hemingway, 22). Robert Cohn, too, is immediately captivated by Brett, and a short time later, he says, â€Å"She’s a remarkably attractive woman† (Hemingway, 38). She is a strong and independent woman and probably these are the features that attract men more than her physical beauty. Her real tool is her charisma that strikes the men around her. Every significant male character in the novel, at one time or another, comments on Brett’s female attractiveness. When he is introduced to Brett, Bill Gorton says, â€Å"Beautiful lady† (Hemingway, 74); Mike Campbell says, â€Å"Brett, you are a lovely piece. Don’t you think she’s beautiful? † (Hemingway, 79) These compliments are like a refrain that is reiterated through the rest of the novel. Despite the abounding attention on men’s side Brett rejects to become committed to a single man, at least physically. Neither the affluence of attention nor her independence makes Brett a happy woman. Having first appeared as a careless free woman Brett Ashley turns out to be an unhappy and miserable creature just the same as all those who lived through the war. Brett is often described in the literary criticism as sexually promiscuous, or even a nymphomaniac, which seems extreme given that in the course of the story she has sexual relationships with, at most, three men her fiancee, Mike Campbell; Robert Cohn; and Pedro Romero. Some critics, like Edmund Wilson, assess Brett’s conduct as â€Å"bitch-like†; Wilson interprets Brett Ashley as â€Å"an exclusively destructive force† (p. 238). This interpretation, plausibly, is directly related rely to Brett’s own assertion that she makes to Jake after she leaves Romero: â€Å"You know it makes one feel rather good deciding not to be a bitch† (Hemingway, 245). Nonetheless it is difficult to agree with such interpretation of Brett’s character. First of all it is known that she is one of the â€Å"lost generation†, the people whose youth fell on the post-war period when the relationships and responsibilities were loose and disordered, and so Brett’s behavior merely reflects this time. Furthermore, though Brett never stayed with any man longer than she wanted, she never displayed cruelty in attitude toward men, so she could not destruct them to any degree. And the most important thing which explains Brett’s character is again related to the time of the novel. Brett Ashley belongs to those people whose thoughts are confused being affected by the war. So while looking for her way in life she fails in finding the lull for her psychological disturbances therefore continues her self-abusive conduct. Brett can be profoundly careless of the feelings of others. She scatters cigarette ashes on Jake’s rugs, and when Romero gives her a bull’s severed ear after a successful bullfight, she leaves the gift behind, stuffed in a hotel drawer. Cohn calls her a sadist when she is unmoved by the plight of the horses gored in the bullring. Certainly she uses Jake heartlessly at times, expecting him to introduce her to a man she desires, put up with her affairs, remain steadfast in his devotion to her, and faithfully run to her rescue on short notice when she finds herself at loose ends in another country. Yet she is also deeply unhappy and emotionally fragile. Viewed more sympathetically, she can be seen as a self-destructive woman, traumatized by the ugly and unromantic loss of her first love to dysentery in the war: â€Å"Brett hurts no one in the novel as severely as she hurts herself. Her nymphomania, her alcoholism, her constant fits of depression, and her obsession with bathing are all symptoms of an individual engaged in a consistent pattern of self-abuse† (Whitlow, 56). All in her misery she often complains to Jake, her only true friend, about her aimless existence and unsatisfying life. Her vagrancy from relationship to relationship is assimilated with Jake and company roaming around bars. As the novel unfolds one observes how Lady Ashley transforms from the self-confident independent woman into one who seems extremely awkward being by herself. That is why she is searching for the shelter in more or less stable though platonic relations with Jake. As with the other characters, World War I obviously played the determinative role in the formation Brett Ashley’s character. Having lost her true love during the war she elaborated the pattern of random relations, especially with regard to men. Her skepticism and lost faith in search for true love symbolizes the search of the whole lost generation for their decayed values. Unable to find support in the traditional convictions that imposed certain meaning to her life Brett feels morally lost. Having lost belief in anything Brett together with her friends is trying to escape the reality and fill her empty life with careless wandering from bar to bar, living night life, drinking and entertaining, doing everything that fits into the notion escapist activity. The character of Lady Brett Ashley is developing through the novel from the initial impression of careless but happy woman into the typical representative of post-war generation with aimless way in life. Parties, free love and other kinds of merry-making are only the futile distraction for concealing the sorrow and insecurity that filled her soul.

John Denver’s song â€Å"Calypso† parallels with a number of the themes in Homer’s the Odyssey. The Odyssey’s themes involving Odysseus’ journey back home and the aid of gods and goddesses directly influence â€Å"Calypso.†   Ã‚  Ã‚  Ã‚  Ã‚  The first stanza in Calypso is influenced by Odysseus’ journey to back to his homeland. The first couple of lines compare a dream to sailing on the ocean where at times it is crystal clear and calm while other times like riding on the â€Å"crest of a wild raging storm†. Denver uses the dream metaphor as a means to show that a dream can be like a nightmare or a fantasy. This metaphor is influenced by Odysseus’ good and bad times on the sea. There are many instances where Odysseus faces struggles on the ocean. Whether Odysseus has to fight a huge storm like the one that washes him up on Kalypso’s island or he has to elude dangerous monsters such as Skylla and the whirlpool Kharybdis on the sea, the ocean can be a very dangerous place. Odysseus also encounters times where the sea is very forgiving to him. The storm that washes him up to the land of Phaecia, a fairy-tale fantasyland, results in a safe and smooth passage home along with num erous treasures. â€Å"What?† shouted Damon over the music, while adding: Run – go! telepathically to Elena. If it had merely been Elena's life, she would have been glad enough to die here with the thunderous beauty of Firebird all around her, rathr than facing those steep, invisible steps alone. But it wasn't just her life. It was Stefan's life, too. Still, the flower maiden didn't look particularly menacing, and Elena couldn't summon up enough adrenaline to try making it down that hidous stairway. Damon, let's both go. We have to search the Great Ballroom outside. Only you're strong enough†¦. A hesitation. Damon would rather fight than face that enormous, impossible green field outside, Elena thought. But Bloddeuwedd, despite her words, was now spinning the room around them again, so that she, at the edge of some invisible walkway, could find the exact orb she wanted. Damon lifted Elena in his arms and said: Shut your eyes. Elena not only shut her eyes, but put her hands over them as well. If Damon was going to drop her, she wasn't going to help matters by shouting â€Å"Look out!† as he did it. The sensations themselves were sickening enough. Damon leaped from step to step like an ibex. He seemed barely to touch the steps in going down and Elena wondered – quite suddenly – if anything were after them. If so, it was information she needed to know. She began to lift her hands and heard Damon whisper-snarl â€Å"Keep them shut!† in a voice that few people liked to argue with. Elena peeked out between her hands, met Damon's exasperated eyes, and saw nothing following them. She clamped her hands back together and prayed. If you were really a slave, you wouldn't last a day here, you know, Damon informed her, taking a final leap into space and then setting her down on invisible – but at least level – ground. I wouldn't want to, Elena sent coldly. I swear, I'd rather die. Be careful what you promise, Damon flashed his splendid smile down at her suddenly. You may end up in other dimensions trying to fulfill your word. Elena didn't even try to one-up him. They were out, free, and racing through the glass house down to the stairs to the lower floor – a little tricky in her state of mind, but bearable – and finally out the door. On the grass of the Great Ballroom they found Meredith and Bonnie†¦and Sage. He was actually in white tie as well, although his jacket strained at his shoulders. In addition, Talon was sitting on one – so the problem might be taken care of fairly soon, as she was ripping the material and drawing blood. Sage didn't seem aware of it. Saber was at his master's side, looking at Elena with eyes too thoughtful to be mere animal eyes, but without malice. â€Å"Thank God you came back!† Bonnie cried, running to them. â€Å"Sage came and he has a marvelous idea.† Even Meredith was excited. â€Å"You remember how Damon said we should have brought a diviner? Well, we have two now.† She turned to Sage. â€Å"Please tell them.† â€Å"As a rule, I don't take these two to parties.† Sage reached down to scratch under Saber's throat. â€Å"But a little bird told me that you might be in trouble.† His hand moved up to stroke Talon, ruffling the falcon's feathers slightly. â€Å"So, dites-moi, please: Just how much have you two been handling the half-key you do possess?† â€Å"I touched it tonight and in the beginning, the night we found it,† said Elena. â€Å"But Lady Ulma handled it and Lucen made a chest for it and we've all handled that.† â€Å"But outside the box?† â€Å"I've held it and looked at it once or twice,† said Damon. â€Å"Eh bien! The kitsune smells should be much stronger on it. And kitsune have very distinctive smells.† â€Å"So you mean that Saber – † Elena's voice gave out for pure faintness. â€Å"Can sniff out anything with the smell of kitsune on it. Meanwhile, Talon has very good eyesight. She can fly overhead and look for the glint of gold in case it's in plain sight somewhere. Now show them what they will be searching for.† Elena obligingly held out the crescent shaped half-key for Saber to sniff. â€Å"Voil! And Talon, now you take a good look.† Sage backed away to what was, Elena supposed, Talon's optimal seeing distance. Then when he came back, he said, † Commen;ons!† and the black dog exploded away, nose to ground, while the falcon took off in grand, high, sweeping circles. â€Å"So you think the kitsune were on this grass?† Elena asked Sage, as Saber began racing back and forth, nose still just above the grass – and then suddenly veered out onto the middle of the marble steps. â€Å"But assuredly, they were here. You see how Saber runs, like a black panther, with his head low, and his tail straight? He has business in hand, him! He is hot on the scent.† I know someone else who gives off the same feeling, Elena thought as she glanced back at Damon, who stood with his arms folded, motionless, coiled like a spring, waiting for whatever news the animals would bring. She happened to glance at Sage at the same moment, and she saw an expression on his face that – well, it was probably the same expression she'd been wearing a minute ago. He glanced at her and she blushed. â€Å"Pardonnez-moi, Monsieur,† she said, looking away quickly. â€Å"Parlez-vous fran;ais, Madame?† â€Å"Un peu,† Elena said humbly – an unusual condition for her. â€Å"I can't really keep up a serious conversation. But I loved going to France.† She was about to say something else, when Saber barked once, sharply, to attract attention and then sat bolt upright at the curb. â€Å"They came or left in a carriage or litter,† Sage translated. â€Å"But what did they do in the house? I need a trail going the other way,† Damon said, looking up at Sage with something like raw desperation. â€Å"All right, all right. Saber! Contremarche!† The black dog instantly turned around, put its nose to the ground as if it afforded him the greatest delight, and began running back and forth across the stairs and the lawn that formed the â€Å"Great Ballroom† – now becoming pitted with holes as people took shovels, pickaxes, and even large spoons to it. â€Å"Kitsune are hard to catch,† Elena murmured into Damon's ear. He nodded, glancing at his watch. â€Å"I hope we are, too,† he murmured back. There was a sharp bark from Saber. Elena's heart leaped in her chest. â€Å"What?† she cried. â€Å"What is it?† Damon passed her, grabbed her hand, and dragged her in his wake. â€Å"What has he found?† Elena gasped as they all reached the same point simultaneously. â€Å"I don't know. It's not part of the Great Ballroom,† replied Meredith. Saber was sitting up proudly in front of a bed of tall, clustering pale lavender (deep violet) hydrangeas. â€Å"They don't look like they're doing too well,† said Bonnie. â€Å"And it's not below any of the upper ballrooms, either,† Meredith said, stooping to get at Saber's height and then look up. â€Å"There's just the library.† â€Å"Well, I know one thing without a question,† Damon said. â€Å"We're going to have to dig up this flower patch and I don't fancy asking Ms. Larkspur-eyes-Now-I-have-to-kill-you for her permission.† â€Å"Oh, did you think they were larkspur, her eyes? Because I thought of bluebells, rahthah,† said a guest behind Bonnie. â€Å"Did she really say she had to kill you? But why?† another guest, nearer to Elena asked nervously. Elena ignored them. â€Å"Well, let's put it this way, she's certainly not going to like it. But it's the only clue we've got.† Except, I suppose, if the kitsune meant to leave it here, but then took off in a coach, she added voicelessly to Damon. â€Å"So that means the show can commence,† cried one of the young vampire fans, stepping toward Elena. â€Å"But I don't have my amulet back,† Damon said flatly, moving in front of Elena like an impenetrable wall. â€Å"But you will in minutes, surely. Look, couldn't some fellows backtrack with the dog to wherever the bad guys came from – came to the estate from, if you get me? And meanwhile we can be getting on with the show?† â€Å"Can Saber do that?† Damon asked. â€Å"Follow a carriage?† â€Å"With a fox in it? But of course. Actually, I could go with them,† Sage said quietly. â€Å"I could make sure that these two enemies are caught if they are on the other end of the trail. Show them to me.† â€Å"These are the only shapes I know.† Damon reached out two fingers and touched Sage's temple. â€Å"But, of course, they'll have more forms, possibly infinite ones.† â€Å"Well, they are not our priority, I assume. The, ah, amulet is.† â€Å"Yes,† Damon said. â€Å"Even if you don't land a blow on them, get the key half and race back.† â€Å"So? Even more important than revenge,† Sage said softly, shaking his head in wonder. Then he added quickly. â€Å"Well, I will wish us good luck. Any adventurous types who want to go with me? Ah, good, four – very well, five, Madame – is enough.† And he was gone. Elena looked at Damon, who was looking back with blank, black eyes. â€Å"You really expect me to do – that – again?† â€Å"All you need to do is stand there. I'll make sure you lose as little blood as possible. And if you ever want to stop we can have a signal.† â€Å"Yes, but now I understand. And I can't handle it.† His face went cold suddenly. Shutting her out. â€Å"You're not required to handle anything. Besides, isn't it enough if I say it's a fair bargain for Stefan?† Stefan! Elena's entire body went through some sort of elemental change. â€Å"Let me share it,† she begged, and knew that she was begging and knew what Damon was going to say. â€Å"Stefan is going to need you when we get out. Just make sure you can handle that.† Stop. Think. Don't bash his head in, Elena's brain told her. He's pushing your buttons. He knows how to do it. Don't let him push your buttons. â€Å"I can handle both,† she said. â€Å"Please, Damon. Don't treat me as if I were – one of your one-nighters, or even your Princess of Darkness. Talk to me as if I were Sage.† â€Å"Sage? Sage is the most frustrating, cunning – â€Å" â€Å"I know. But you talk to him. And you used to talk to me, and now you're not. Listen to me. I can't bear to go through this scenario again. I'll scream.† â€Å"Now you're threatening – â€Å" â€Å"No! I'm telling you what will happen. Unless you gag me, I'll scream. And scream. As I would scream for Stefan. I can't help it. Maybe I'm breaking down†¦.† â€Å"But don't you see?† Suddenly he had whirled around and taken hold of her hands. â€Å"We're almost at the end. You, who've been the strongest all along – you can't break down now.† â€Å"The strongest†¦Ã¢â‚¬  Elena was shaking her head. â€Å"I thought we were right there, on the verge of understanding each other.† â€Å"All right.† His words came as hard chips of marble now. â€Å"What if we do five?† â€Å"Five?† â€Å"Five strokes instead of ten. We'll promise to do the other five when the ‘amulet' is found, but we'll run when we do find it.† â€Å"You would have to break your word.† â€Å"If it takes that – â€Å" â€Å"No,† she said flatly. â€Å"You say nothing. I'll tell them. I'm a liar and a cheat and I've always played with men. We'll see if I can't finally put my talents to good use. And there's no point in trying any of the other girls,† she added, glancing up. â€Å"Bonnie and Meredith are wearing gowns that would fall right off if you slashed them. Only I have a bare back.† She pirouetted in place to show off how her dress met only very high at the neck in a halter and very low in the back in a V. â€Å"Then we're agreed.† Damon had a slave refill his goblet and Elena thought: we're going to be the tipsiest act in history, if nothing else. She couldn't help but shiver. The last time she had felt an inner trembling was from Damon's warm hand on her bare back as they danced. Now, she felt something much icier, just a draft of cold air perhaps. But it drew her mind to the feeling of her own blood running down her sides. Suddenly Bonnie and Meredith were there beside her, forming a barricade between her and the increasingly curious and excited crowd. â€Å"Elena, what's happened? They said a barbarian human girl was to be whipped – † began Meredith. â€Å"And you just knew it had to be me,† completed Elena. â€Å"Well, it's true. I don't see how I can get out of it.† â€Å"But what have you done?† Bonnie asked frantically. â€Å"Been an idiot. Let some fraternity-type vampire boys think that it was a sort of magic act,† Damon put in. His face was still grim. â€Å"That's a little unfair, isn't it?† Meredith asked. â€Å"Elena told us about the first time. It sounded as if they jumped to the conclusion that it was an act all by themselves.† â€Å"We should have denied it then. Now, we're stuck with it,† Damon said flatly. Then, as if he were making an effort, â€Å"Oh, well, maybe we'll get what we came for, anyway.† â€Å"That was how we found out – some idiot came running down the steps yelling about an amulet with two green stones.† â€Å"It was all we could think of,† Elena explained wearily. â€Å"It's worth it for Damon and I to do this if only we can find the other half of the key.† â€Å"You don't have to do it,† Meredith said. â€Å"We can just leave.† Bonnie stared at her. â€Å"Without the fox key?† Elena shook her head. â€Å"We've already been through all that. The unanimous decision was to do it this way. She looked around. â€Å"Now where are the guys that wanted to see it so much?† â€Å"Looking in the field – that used to be a ballroom,† Bonnie replied. â€Å"Or getting shovels – lots of 'em – from Bloddeuwedd's gardening compound. Ow! Why'd you pinch me, Meredith?† â€Å"Oh, my, did that pinch? I meant to do this – â€Å" But Elena was already striding away, as eager now as Damon was to get it over with. Half over with. I just hope he remembers to change into his leather jacket and black jeans, she thought. In white tie – the blood – I won't let there be any blood. The thought was sudden and Elena didn't know where it came from. But in the deepest reaches of her being, she thought: he's been punished enough. He was trembling in the litter. He thought about another person's well-being from minute to minute. It's enough now. Stefan wouldn't want him to be hurt any more. She glanced up to see one of the Dark Dimension's small, misshapen moons moving visibly above her. This time the surrender she made to it was bright red, a feather shining in sullen crimson light. But she gave herself up to it unreservedly, body and soul, and it rested on the hallowed spring of eternal blood that was her womanhood. And then she knew what she had to do. â€Å"Bonnie, Meredith, look: we're a triumvirate. We have to try to share this with Damon.† No one looked enthusiastic. Elena, whose pride had been entirely broken from the moment she first saw Stefan in his cell, knelt down in front of them on the hard marble step. â€Å"I'm begging you – â€Å" â€Å"Elena! Stop that!† Meredith gasped. â€Å"Please get up! Oh, Elena – † Bonnie was a breath away from tears. And so, it was small, softhearted Bonnie who turned the tide. â€Å"I'll try to teach Meredith how. But anyway, we'll at least share it between the three of us.† Hug. Kiss. A murmur into strawberry hair, â€Å"I know what you see in the dark. You're the bravest person I know.† And then, leaving a stunned Bonnie behind, Elena went to collect spectators for her own whipping.

Criminal Law Foundations Essay

The United States Constitution has been amended since its origination. These amendments are meant to help our Nation adjust to the ever changing times. Our Bill of Rights is contended in the first ten amendments. The Bill of Rights is instilled into our constitution to protect the citizens of the United States from unfair and unjust treatment by their own government. Our government is protected and enforced through local police departments and our Bill of Rights gives certain freedoms to the citizens and suspect of the police prior to and during prosecution by the criminal justice system. From arrest to sentencing, the Bill of Rights protects us. This paper will specifically discuss the fourth, fifth, and sixth amendments of the Bill of Rights and how they pertain to both juvenile and adult court proceedings. The Bill of Rights also governs the government by placing limits to the extent of their reach, or power, and how that power is used against its own citizens. The Bill of Rights, or ten amendments, took adoption into our Constitution in 1789 by the efforts of James Madison. Fourth Amendment Our Fourth Amendment guarantees protection from unreasonable or unlawful search and seizure. This particular amendment is a component of the Bill of Rights that gives citizens the right to secure their persons, belongings and homes; each of which are protected under the Fourth Amendment from any unreasonable or unlawful search and seizure. The bill strongly states that this right shall never be violated as well no warrants shall be issued, unless there is a probable cause, which has approval by an oath of affirmation and the description of the place under inspection, the affected person or the possessions to be seized. In both juvenile and adult courts, the constitutional safeguard is applied (Emanuel 2009). Both juvenile and  adults are afforded this right by our Constitution to be free from harassment that is not been approved by the law with stated warrants specifying the desire and description of objects to be seized. If this right is violated in any way it is most likely the v iolator would face criminal charges or consequences due to their actions for denying citizens their Fourth Amendment right. Fifth Amendment Our Fifth Amendment discusses due process, self-incrimination, double jeopardy and eminent domain. Consider this Amendment as a safeguard stating no person shall be under pressure to answer for any crime, unless he or she is under the indictment of a grand jury (Abadinsky, 2008). The only exception to the Fifth Amendment would be the cases involving any military or militia presently servicing or during war times. Our Fifth Amendment also states; No person shall be put in jeopardy of limb or life twice. No one shall be put under pressure to testify against himself. No one shall face depletion of liberty, life or property, unless the same has approval by the law. No private property shall be in for public use, unless the owner gets due compensation. This is the so called Miranda bill. In adult and juvenile courts, persons have the right to stay silent and not to plead guilty of any offence. No one is free to make the suspect reveal anything, unless in front of a jury and within the pro tection of a counsel. The juveniles are immature and may not know their rights. Owing to this law the minors have constitutional protection from any illegal exploitation (Hartley & Rabe, 2008). Sixth Amendment Our sixth amendment discusses the right of trial by jury, the rights of the accused, the right to a speedy trial, the right to an attorney, and the right to a public trial. The Sixth Amendment states that any subject suspected of criminal activity resulting in prosecution will have the absolute right to a speedy trial by public and of a jury of their peers (Abadinsky, 2008). All subjects or suspects shall be informed of the charges against him/her regarding any arrest of criminal activity, witnesses are also available to testify for and against the accused according to the Sixth Amendment and the accused will be given witnesses prior to jury trial,  this right is afforded to citizens under the Sixth Amendment of our Constitution. The suspect will have the right to have his/her own witness as well as a presentation of defense by his/her attorney in order to conflict with prosecutor evidence given against him/her. Our constitution affords the right to be given a fair, speedy and public trial in both juvenile and adult criminal court proceedings. Not only do they have the right to a fair, speedy, and public trial; but they are afforded the right to legal representation for any offense brought to the criminal justice system. This ensures the rights of the accused to place defense upon any mistaken identities or statements of the facts regarding the crime in which they have been charged. The right to a speedy trial gives the accused the ability to precede with his/her normal life without undergoing a long drawn out process of the court system inflicting undue influence on their lives. Delay of justice may bring a lot of frustrations to the accused, thus, the speedy and public trial is a great variant (Wilkerson 1973). Impacts of the Safeguards on day to day Operations in the Court All of the Amendments that have been added to our Constitution have guaranteed a well needed transformation of our criminal justice system. The Amendments allow the citizens of the United States to be informed of their rights. By doing so a better understanding is gained between the relationship of our government and our citizenship accordingly, thus harmonizing the relationship between government and citizenship bringing a sense of understanding and relief for individuals. Having the right to an attorney gives the accused an equal stance in the courtroom to defend against an accusation of criminal activity with a fair and just trial. This ensures that the citizens of the United States involved with criminal activity or accused of criminal activity have proper representation and rebuilds trust that the government cannot abuse their power against them (Champion, 2010). Imagine a juvenile without these rights, they would h ave no way to argue their innocence without legal knowledge, thus falling to the will of the government. The hiring of an attorney can come through private methods or be available through the state with no charge, at any rate, ensuring counsel for defense. The inclusion of the Miranda warnings protects all accused of criminal activity from self-incrimination due to pressure or undue  influence. Law enforcement adjusts their tactics by moderating their power to gather information through unwarranted measures, deceit, and playing subjects against each other is a common method to gain a voluntary confession. With the Miranda warnings, subjects can have the right to remain silent and refrain from stating incriminating statements against themselves (Abadinsky, 2008). Delaying the justice system is often expensive and comes with stress that plays into the accused everyday lives thus, creating more chaos than is due for the circumstance. Our Constitutional rights ensure fair treatment and the rights of citizens to know their course of action is readily available. The safeguards against unlawful search and seizure ensures citizens their dignity and privacy is not disregarded and their lives are protected affording a sense of stability and comfort against the force of the Nation’s government (Hartley & Rabe, 2008). This changes the view of law enforcement and the communities they serve and opens the door for acceptance of their position and an understanding of the job they are doing through community actions and other theoretical methods of law enforcement. Conclusion Thus the Fourth, Fifth, and Sixth Amendments of the Bill of Rights are in place to secure the rights of the citizens of the United States. Following these Amendments can afford our Nation the right to boast of fairness and justice being served without conflicting with personal rights giving our government an admirable placement regarding the criminal justice process. It is the hope of our Constitution, and the Amendments that every citizen of the United States is educated to their rights and utilizes the Constitution to protect themselves from unfair treatment and prevents the government from exerting their brute force to bully a conviction of an innocent citizen, or placing improper sentencing on a guilty party. Gasoline vs. electric automobiles is an interesting instance of this. In practice, there really are only a few automobile alternatives: gasoline automobiles, diesel, and electrics. Gasoline and diesel  prices, as youll remember, have been extremely volatile since the late 1980s. As U.S. gasoline prices reached $5/gallon in some West Coast cities, the demand for electric cars increased. However, since 2014 gasoline prices have fallen. With that, demand for electrics fell with them, putting automobile manufacturers in a peculiar bind. They needed to sell electrics to keep their fleet mileage averages down, but consumers began buying gasoline trucks and larger gasoline autos again. This forced manufacturers Fiat/Dodge  is a case in point to lower the price of electrics below their actual production cost in order to keep selling gasoline-powered trucks and muscle cars without triggering a federal government penalty.   Complimentary Goods A local Seattle band has a breakthrough hit millions and millions of streams, many, many downloads and a  hundred thousand albums sold, all in a few weeks. There are many benefits and significance for a child to have a security object and numerous misconceptions on regarding the relationship between a young child and their security object. It is very beneficial for younger children to have a security object. Most children will grow attached to an object when they are starting to be weaned from their mother because that’s a very emotional time. This object helps the child get through this critical transition so it is not so horrible. Young children with security objects do not throw such a fit when they have to be left with other adults and children, because they feel like you are still with them through this stressful situation. It is crucial for the managers to adjust and control its performance while it goes through different stages. The effect respectively will be also different on different stages. Therefore, considering the life cycle of SSC systems is important when investigating the effects on company competitiveness. The product life cycle tend to go through the five stages of products: †¢ Service/product development; †¢ Market introduction; †¢ Growth stage; †¢ Mature stage; †¢ Stage of decline. Each stage is different in effectiveness of the product, expenses, revenue, etc. The first stage usually money intensive as there is no sales revenue and all expenses are covered by different organizations activities, in our case no effectiveness gain from reducing cost of operation. Stage two is quite expensive in our case as technological cost is very high. The purchase of the machineries and shops infrastructure adjustments to accommodate it are required. Moreover the staff and customers trainings and special promotions materials must be prepared. The third stage is continuous use of SSC by customers and therefore operational cost reduction becomes positive revenue, which might cover the marketing expenses. The fourth stage is characterised by very low costs of operation as number of customers who is using it increased. The final stage might come as soon as more efficient and productive technology will arrive and current become outdated. (Day, 1981) The progression of a product through these stages is not certain however. Some products may stay in the mature stage forever, for example commodities such as milk, others might not even rich stage of maturity. These products go through their life cycle as marketers â€Å"marketing mix† strategies change. For example, advertising is informative stage of the introduction, maturity stages, winning in the growth and in the decline stage reminder-oriented. However, he further states that the specific activities that are vital to a firms competitive advantage depend on which industry the firm operates†. (Porter, 1985, 1990) Stabell and Fjeldstad (1998) however have investigated the application of the value chain model to a variety of industries and have experienced problems in applying the value chain frame work to more than two-dozen firms. They have found that the value chain is suitable for describing and understanding the value creation logic of manufacturing firms, but that it proves problematic when analyzing activities in service industry firms. They argue that â€Å"problems arise from difficulty to assign and analyze activities in terms of the five generic primary value chain categories proposed by Porter, leading to unclear explanations of value creation†. Therefore, Stabell and Fjeldstad (1998) suggest that â€Å"the value chain can be considered as one of three generic value configurations to facilitate the understanding and analysis of firm-level value-creation logic for a broad range of industries and firms†. The additional two value models besides the value-chain are the value network and the value shop. The importance shop model applies to firms where price is created by â€Å"mobilizing income and performance to resolve an exacting customer difficulty†, for example professional service firms dealing with medicine, law, architecture and engineering. The value network model refers to firms that generate cost by â€Å"facilitating an organization relationship among their customers using a mediator technology†. Stabell and Fjeldstad (1998) also propose alternative presentation formats for both models that represent their unique value creation logic. For the purpose of this research both Porters value chain and Stabell and Fjeldstads value network is of importance. Although Stabell and Fjeldstad state that according to their findings the value chain is mostly useful for manufacturing firms, for our investigation of supermarkets ‘traditional operations, the value chain is most fitting, with one small alteration. However, in also considering the introduction of a new type of service offering through technology-based self-service checkouts, it is found necessary to complement the value chain model with the value network model in order to be able to capture the value adding activities of SSC. The combination of the different value-creating logics, as suggested for this research, has also been proposed by Norman and Ramirez (1993). Since the main purpose of the research is to investigate the effects of SSC in supermarkets, the value network is of central importance, which is discussed in further detail below. The Value Network â€Å"Value networks use a ‘mediating technology to link clients and customers who wish to be interdependent.† According to Stabell and Fjeldstad (1998), â€Å"the firm provides a networking service through the mediating technology and thus facilitates exchange relationships among customers distributed in space and time†. For the consideration of SSC, the value network idea is modified to mean that the firm is the network itself, linking its customers not to each other but to the firm itself, facilitating a more interdependent exchange relationship between the firm and its customers. (Knox, 1998) Customer satisfaction brings many benefits. Satisfied customers are fewer prices sensitive; they purchase more items, not go to competitors and stay longer. (Zineldin, 2000) Customer satisfaction is directly related with the customer complaint process management. If customer complains more, then, it increases more customer satisfaction. Customer complains about the product or service he/she receives, then, supermarket can achieve more customer satisfaction (Johnston, 2001) â€Å"The product innovations, staff service, price, convenience and business profile are all determinants of customer satisfaction†. (Athanassopoulos, 2000) Later, Bejou et al. (1998) propose that â€Å"customer satisfaction can be enhanced through relationships, provided they are developed and managed to the customer`s satisfaction† Customer retention is not directly related with the customer satisfaction. Sometime customer do not change service provider because of the alternative circumstances, but, customer satisfaction level remain the same. Sometime customers do not have any choice to change their service provider, so, they stick with their existing provider. Hallowell (1996) argues that customer satisfaction cannot produce life time customer loyalty even though customer satisfaction has been increased, but, retention can be related with customer satisfaction. Retention can be understandable as â€Å"to do business or exchange a commitment to continue with a particular company on an ongoing basis†. (Zineldin, 2000) Retaining old customers are easy and cheap to keep as compared to the new customers because they are more loyal and less price sensitive. They keep their loyalty to their existing service provider and do not change their loyalty to the new service provider. It increases customer retention, satisfaction, lower price sensitivity, higher market share, higher productivity and higher efficiencies. (Reichheld, 1995) The authors suggest that in order to retain customers, companies should always change and developing their product and services to meet the ever changing needs of customers. â€Å"The concept of acquiring, developing and retaining customers from a cognitive and affective perspective†, they provide examples of how cognitive and affects are used to increase retention. (Desai and Mahajan, 1998) â€Å"Customer satisfaction is a direct determining factor in customer loyalty, which, in turn, is a main presentation of customer retention†. (Gerpott et al., 2001) Customer satisfaction can be achieved by customer retention. Customer complaint process can boost the stage of customer satisfaction that result in customer retention. Employee perspective is also very important with relation of the customers. Individual relationship with the customer can boost the level of customer satisfaction. It is direct related with the mental theories of customer and employee perspectives. Managers should be aware of customer wants and needs as well as employee mental perspective. Different employees keep different level of relationship with the customers that could affect the customer satisfaction and retention level. Therefore, Managers must keep eye into employee/customer relationship and set realistic goals to achieve. (Spreng et al, 1995) Customer Retention Customer retention is directly linked with the customer satisfaction. The framework guide managers to decide which part of customer satisfaction has more collision, which part of customer satisfaction needs to be improve and make strategies to retain existing customers. An individual level model of loyalty and customer retention has been developed, that can be used to predict effects of service level improvement at supermarket. â€Å"Customer satisfaction has been changed recently from transactional marketing to relationship marketing†. (Grà ¶nroos, Sheth and Parvatiyar, 1994) â€Å"To all marketing activities directed toward establishing, developing, and maintaining successful relational exchanges† (Morgan and Hunt, 1994) â€Å"Customer satisfaction has been treated as essential instrument for the customer retention has gained significant importance in relational marketing approaches†. (Rust and Zahorik, 1993) Kotler sums this up when he states: â€Å"The key to customer retention is customer satisfaction† (Kotler, 1994) â€Å"The assumption that satisfaction/dissatisfaction meaningfully influences repurchase behaviour underlies most of the research in this area of inquiry†.
